Case Studies
CSMG provided expert testimony in a court
case brought by a bankrupt wireless service provider (Devon)
that was affiliated with Adelphia, the cable MSO (also bankrupt
at this point). In the first phase of the case, counsel was
seeking to learn about the wireless industry in general, and
the specific business history of Devon. CSMG delivered wide-ranging
research in the form of presentations and a large reference
deck, covering the wireless industry from demand and supply
perspectives, Devon's participation, possible valuations of
its assets, and transactions in the industry. In the latter
phase of the case, CSMG delivered an expert report on the
key questions in the case. CSMG Vice President Susan Simmons
was deposed, and was available to testify until the case was
settled. The end result of the case was that the opposing
party (trustee for claims on debts owed by Devon) settled
the action for $0.
For a consortium of incumbent US telephone companies, CSMG
developed a financial analysis to assess the cost to competitive
carriers of bringing lateral private circuits to large buildings
that they cannot currently reach via unbundled network elements
under the Telecom Act. We showed that it was not financially
necessary to extend the Act to include further elements for
unbundling to make these laterals viable. We contributed materials
to the consortium as it developed its position, and our work
was filed with the FCC.
